These Terms of Service govern your use of FileSworn, a secure evidence sharing platform operated by Verifore Technologies LLC, a Louisiana limited liability company.

By creating an account, accessing, or using FileSworn, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.
FileSworn provides secure evidence sharing with cryptographic integrity verification, forensic watermarking, chain of custody logging, and self-authenticating evidence certificates. The Service is designed for legal professionals managing sensitive evidence and media.
Core Features:
By default, files uploaded to FileSworn use Temporary Access with automatic expiration based on your selected duration (24 hours, 48 hours, or 7 days). Professional and Enterprise subscribers may upload files as Preserved Evidence for permanent storage. After Temporary Access expiration, files are permanently deleted and cannot be recovered.

By default, files uploaded to FileSworn use Temporary Access with automatic expiration. When you upload a file, you select an expiration duration (24 hours, 48 hours, or 7 days). After this duration, the file is automatically and permanently deleted. Professional and Enterprise subscribers may instead upload files as Preserved Evidence for permanent retention.
You may manually "shred" a file at any time before expiration. Shredding immediately and permanently destroys:
Shredded files cannot be recovered under any circumstances. Chain of custody certificates generated before shredding remain available for download for 7 years.
Every video, image, or audio file viewed through FileSworn is watermarked with the viewer's verified email address via a visible overlay during playback. This watermarking is intentionally visible and serves as both a deterrent and an attribution mechanism.
Important Limitations: FileSworn does not claim to prevent screen capture, screen recording, or camera-based recording of content. Forensic watermarking provides identity attribution, not content protection. If evidence is leaked, the watermark identifies who viewed it—it does not technically prevent the leak.
Watermark visibility may vary based on the viewer's device, screen settings, and recording method.
Every file upload generates a SHA-256 cryptographic hash that uniquely identifies the file's content. Any modification to the file would result in a different hash, providing cryptographic proof of integrity.
Every file access is logged with:
FRE 902(13) self-authenticating evidence certificates are available for Professional and Enterprise tiers. These certificates compile the file's hash, upload record, and complete access log into a court-ready document.

Prohibited Uses:
Verifore Technologies LLC reserves the right to suspend or terminate accounts that violate these terms. Severe violations (such as illegal content) will be reported to law enforcement.
Paid subscriptions (Professional, Enterprise) are billed via Stripe on a monthly or annual basis. Annual billing provides a 20% discount compared to monthly billing.
Failed Payments: If a payment fails, you will be notified via email. If payment is not resolved within 7 days, access to paid features will be restricted. After 30 days, your account will be suspended.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends.
Refunds: See our Refund Policy for details. Annual subscribers may receive a pro-rated refund within the first 30 days.
Stripe Tax: Applicable taxes are automatically calculated and applied at checkout based on your location.

Consulting engagements are governed by separate statements of work (SOW) agreed upon between the parties. These Terms of Service apply to the FileSworn platform only, unless a consulting SOW explicitly incorporates them by reference.
By creating an account or continuing to use FileSworn after logging in, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must stop using the Service and close your account.
We may update these Terms from time to time. Material changes will be communicated via email with 30 days advance notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
FileSworn is provided "as is" without warranty of any kind, express or implied. Verifore Technologies LLC makes no warranties regarding the accuracy, reliability, or suitability of the Service for any particular purpose.
Maximum Liability: Verifore Technologies LLC's total liability for any claims arising from your use of FileSworn is limited to the subscription fees you paid in the preceding 12 months.

Users are responsible for maintaining their own backups of critical evidence. While FileSworn provides integrity verification and chain of custody tools, we strongly recommend downloading important files and certificates for local storage.
Verifore Technologies LLC retains all rights, title, and interest in the FileSworn platform, including all software, branding, designs, and technology.
Your Content: You retain all rights to content you upload to FileSworn. By uploading content, you grant Verifore Technologies LLC a limited, non-exclusive license to process, store, watermark, and transmit that content solely for the purpose of providing the Service to you.
This license terminates when you delete the content or close your account, except to the extent necessary to comply with legal retention requirements (e.g., access logs retained for 7 years).
We may update these Terms of Service from time to time. Material changes will be communicated via email to the address associated with your account, with 30 days advance notice before the changes take effect.
Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you disagree with the changes, you may close your account before the effective date. No refunds will be provided for unused time in your billing period unless required by law.
These Terms of Service are governed by the laws of the State of Louisiana, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of FileSworn shall be resolved in the state or federal courts located in Jefferson Parish, Louisiana. You consent to the exclusive jurisdiction of these courts.
